Social Security Disability

We have substantial experience with Social Security Disability cases. We assist with a wide range of services in this area, from a case review to representing claimants on appeals of denial of benefits from the Social Security Administration.

Here are some important points to know about Social Security Disability cases to keep in mind when navigating the system. While these points do not cover all the possible issues that could arise, they are the most common issues.

  • There are two types of Social Security benefits: Social Security Supplemental Income benefits and Social Security Disability Insurance benefits. An error often committed by many individuals is that they apply for only one of the benefits when they should be applying for both benefits. This prevents individuals from missing out on qualifying for Social Security Disability Insurance benefits when they only apply for Social Security Supplemental Income benefits and vice versa.
  • Not submitting ALL the necessary documentation to qualify for Social Security Disability. It is important to remember that Social Security has a 5-step process for determining whether an individual is considered disabled. One of these steps is determining whether the medical records submitted is enough to determine whether the individual is considered disabled. Often, individuals fail to include ALL of the medical records that are needed when submitting the application for benefits. Another area in which documentation is needed is the amount of work that is needed to qualify for Social Security Disability Insurance benefits. Without that documentation, the Social Security Administration can’t determine whether you have worked enough “quarters” to qualify for Social Security Disability benefits.
  • Another common issue we often see is that Social Security will sometimes make errors in the calculations of how much in benefits an individual qualifies for or errors in the calculations of whether an individual has been overpaid. It is important to review these calculations carefully to be sure that these errors are caught in time.
